Credit Card Surcharging Rules, Convenience Fees & ACH
Credit card processing fees (typically 2.9% + 30¢) can represent significant overhead on large residential jobs. Contractors often pass processing fees to customers or offer zero-fee ACH bank transfers. However, surcharging is subject to strict state laws and card network rules.
Key Compliance Requirements:
- State-Specific Prohibitions & Restrictions: Credit card surcharging is prohibited or heavily restricted by statute in several jurisdictions (including Connecticut, Massachusetts, Maine, and New York under specific disclosure rules). Check your specific state and municipal commercial regulations before enabling surcharges.
- Network Surcharge Caps: Major card networks (Visa, Mastercard) cap credit card surcharges at your actual cost of card acceptance or a maximum of 3% (whichever is lower). Surcharging debit cards is strictly prohibited nationwide under federal law (Dodd-Frank Act).
- Pre-Transaction Disclosure: Surcharges must be clearly disclosed at your point of entry and on proposal quote summaries before the customer submits payment.
- Zero-Fee ACH Bank Transfers: For large residential projects (over $2,000), offering direct bank-to-bank ACH transfers eliminates high card percentage fees while remaining fully compliant nationwide.
